EVATAC Full-Throttle Giveaway Terms and Condition

  1. EVATAC Full-Throttle Giveaway (“Promotion”) is conducted by EVATAC (ABN 63 133 201 206) of U1/69 Delta St, Geebung 4034, QLD (“Promotor”)

  3. This Competition commences at 12:00am 16 November 2023 and ends 11:59pm 04 January 2024 (AEST). (“Promotion Period”).
  4. The sections on How to Enter, Draw and Winner Notification, Prizes and Miscellaneous Provisions form part of these Terms and Conditions.
  5. This Promotion is only open to Australian customers aged 18 years or older who have not been discovered to have breached these Terms and Conditions.
  6. Entry into this Competition is deemed to be acceptance of these Terms and Conditions. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of these Terms and Conditions generally.
  7. Each entrant acknowledges that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of an entrant’s ineligibility to enter after the Promoter has awarded a Prize to the ineligible entrant. Return of a Prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.

    HOW TO ENTER:
  8. To enter, entrants must, during the Promotion Period:
    1. Purchase any item from the EVATAC AU online store (evatac.com.au) during the promotion period.
  9. Entries are deemed to be received at the time of receipt into the database and NOT at the time of transmission by the participant.
  10. Receipts cannot be shared, transferred, sold or traded.
  11. Entries can only be received via the online store (evatac.com.au).
  12. Multiple entries are permitted providing they comply with individual entry requirements as outlined in clause 8.

    DRAW AND WINNER NOTIFICATION
  13. Major Prize Draw: The draw will take place at U1/69 Delta St, Geebung 4034 QLD at 9:00am January 05.
  14. Winner will be notified by email within two (2) business days of the prize draw and their name will appear on the EVATAC Instagram account - https://www.instagram.com/evatac.co/ and facebook account - https://www.facebook.com/evatac.com.au/ 
  15. Any prize that remains unclaimed for a period of three (3) months will be forfeited by that winner and will be redrawn at 9:00am (AEST) 05th April 2024 at U1/69 Delta St, Geebung 4034 QLD. Winners of an unclaimed prize draw will be notified by telephone and email within two (2) business days of the date of the redraw, and their name will appear on the EVATAC Instagram account - https://www.instagram.com/evatac.co/.

    PRIZE
  16. Major Prize: one (1) Motorbike 2018 KAWASAKI VULCAN S valued at $8,000 + a $600 Coles Express Gift-Card or $8,000 Australian Dollars.
  17. Total prize pool in Australia valued at $8,600 incl. GST.
  18. If for any reason any elements of the specified prizes are unavailable, the Promoter reserves the right to replace it with a prize of the same or higher value and of similar specification, subject to any written directions from a regulatory authority.
  19. Prizes, including the option of an $8,000 AUD cash alternative, are not transferable, saleable, or exchangeable and must be accepted as awarded.
    MISCELLANEOUS PROVISIONS
  20. If there is a dispute as to the identity or details of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity or details of the entrant.
  21. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome).
  22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Businesses and/or its authorised representative; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winning business or Eligible Business (or its authorised representative); or (e)use of a prize.
  25. The Promoter will use and handle personal information collected as set out in its privacy policy available on the Promoter’s website https://evatac.com.au/pages/privacy-policy In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information collected from entrants for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter, all data will be stored securely in Australia and will not be shared outside Australia.
  26. The Promoter’s decisions in relation to this Promotion are final and no correspondence or communication will be entered into in relation to any aspect of this Promotion.
