EVA Elite Membership – T&Cs

Overview

EVA Elite is a paid membership program offered by EVA Athletic, providing access to exclusive pricing, promotions, and additional benefits across selected products.

By purchasing an EVA Elite Membership, you agree to these Terms & Conditions.

Membership Term

EVA Elite is a 12-month minimum membership designed to give you ongoing access to exclusive pricing, rewards, and member-only benefits.

By joining, you’re committing to a full 12-month term, billed monthly for your convenience.

At $14.95 AUD per month, the total minimum commitment over the membership period is $179.40 AUD, giving you continuous access to all Elite benefits across the year.

Your membership begins on the date of purchase and remains active for the full 12-month period.

Pricing & Billing

Membership is billed at $14.95 AUD per month.

By purchasing this membership, you authorise EVA Athletic to:

• Charge your selected payment method on a recurring monthly basis
• Automatically process payments for the duration of your membership

If a payment fails, we may attempt to reprocess the payment. Continued failure may result in suspension of membership benefits until payment is resolved.

4. Cooling-Off Period

You may cancel your membership within 7 days from the date of purchase (“Cooling-Off Period”).

To be eligible for cancellation during this period:

• Any products purchased using member pricing must be returned
• All items must be unused, unworn, and in original condition
• All original packaging must be intact, with no damage, tears, or markings
• Clothing must be unwashed

All benefits received during the Cooling-Off Period must be reversed or returned where applicable, including any discounts, promotional offers, or free gifts.

If these conditions are not met, cancellation may be declined.

5. Early Cancellation (After Cooling-Off Period)

After the Cooling-Off Period, your membership remains active for the full 12-month term.

You may request early cancellation by electing to pay out the remaining balance of your membership.

The remaining balance is calculated as:

$14.95 AUD × remaining months in your 12-month term

Once this balance has been paid, your membership will be cancelled and no further charges will apply.

We may, at our sole discretion, consider early cancellation requests in exceptional circumstances.

6. Auto-Renewal

At the end of the initial 12-month term, your membership will automatically continue on a month-to-month basis.

You may cancel at any time after the initial term to prevent further billing.

7. Cancellation Process

After the initial 12-month term, you may cancel your membership at any time through your account or by contacting EVA Athletic support.

Cancellation requests must be submitted prior to your next billing date to avoid further charges.

8. Membership Benefits

Membership benefits may include:

• Exclusive member pricing on selected products
• Promotional offers and early access to releases
• Complimentary gifts or bonuses

All benefits:

• Are subject to availability
• May vary between products
• May be modified or removed at any time

Membership does not guarantee savings on every purchase.

9. Member Pricing

Member pricing applies only to selected products and is not guaranteed across the entire store.

Price differences between standard and member pricing may vary.

10. Free Gift Conditions

Where a free gift is included:

• Limited to one per membership activation
• Subject to stock availability
• Not redeemable for cash

If membership is cancelled within the Cooling-Off Period, the free gift must be returned in original condition.

11. Returns & Refunds

Membership fees are non-refundable, except where required under Australian Consumer Law.

Standard product return policies apply separately to purchased items.

12. Failed Payments

If a payment cannot be processed:

• Membership benefits may be paused
• Access to member pricing may be restricted

Where payments remain outstanding, we reserve the right to pursue recovery of any unpaid amounts associated with the membership term.

13. Misuse of Membership

EVA Athletic reserves the right to suspend or terminate membership where misuse is identified, including:

• Abuse of member pricing
• Resale or commercial use of discounted products
• Fraudulent or suspicious activity

14. Changes to Membership

We may update or modify:

• Membership pricing
• Benefits
• Program structure

Where required, reasonable notice will be provided.

15. Account Responsibility

You are responsible for maintaining accurate account and payment details.

16. Limitation of Liability

To the extent permitted by law, EVA Athletic is not liable for any indirect, incidental, or consequential loss arising from use of the membership.

17. Consumer Rights

Nothing in these Terms excludes or limits your rights under Australian Consumer Law.
